Supreme Court Rejects SC Certificate :
The Supreme Court ne ek mahatvapurn faisla sunaya, Madras High Court ke decision ko support karte hue, jisme ek Christian mahila ko SC certificate deny kar diya gaya tha. Mahila, jo ek Christian ke roop mein paida hui thi, ne Upper Division Clerk ki naukri ke liye Hindu hone ka dawa kiya tha. Court ne kaha ki agar koi vyakti sirf reservation benefits ke liye religion convert karta hai, bina asli dharmik vishwas ke, toh yeh reservation policy ke mool uddeshyon ke khilaf hai.
Justice Pankaj Mithal aur Justice R. Mahadevan ki bench ne kaha ki “sirf labh lene ke liye religion convert karna ek tarah ka Constitutional fraud hai aur reservation policy ke mool adarshon ke khilaf hai.”

Case ka Background
Mahila ne dawa kiya ki uske pita Hindu the aur maa Christian, par dono baad mein Hindu dharm apnaye. Usne ye bhi kaha ki uska parivaar Valluvan jaati se sambandh rakhta hai, aur uske pita aur bhai ko SC certificates mile hain. Lekin, Village Administrative Officer ki report aur documents ne dikhaya ki uske pita ne Christianity adopt ki thi. Mahila ka janm 1990 mein hua aur 1991 mein uska baptism kiya gaya.
Court ki Observations
Supreme Court ne kaha ki Scheduled Caste ka benefit unhi logon ko diya ja sakta hai jo Christianity se Hinduism mein reconvert ho kar apni asli jaati mein dobara accept kiye gaye ho. Mahila yeh sabit nahi kar pai ki usne Hinduism ko fir se apnaya aur uski jaati ne usse dobara accept kiya.
Court ne kaha:
“Conversion ke baad, vyakti apni asli caste kho deta hai. Reconversion ke bina, caste ka dobara upyog nahi ho sakta. Yeh sabit karna zaroori hai ki reconversion ceremony hui ho aur public declaration ke saath dharmik palti ki gayi ho. Mahila ke case mein aise koi saboot nahi mile.”
Dharmik Conversion par Court ka Rukh
Court ne un logon ki alochana ki jo sirf reservation ke labh ke liye religion badalte hain.
“Vyakti tabhi religion badalta hai jab usse naye dharm ke siddhant aur vicharpranali mein vishwas ho. Lekin agar conversion ka maqsad sirf reservation benefits lena hai, toh ise allow nahi kiya ja sakta, kyunki aise motive se policy ka uddeshya khatam ho jata hai.”
Appeal Dismiss
Sabhi praman aur arguments ke baad, Supreme Court ne appeal ko dismiss kar diya.
